A man due to face trial over the shooting of bikie Rocco Curra has had all serious charges against him dropped after his co-accused were acquitted.
Tavita Sua was charged with attempted murder, intention to cause serious injury and recklessly causing serious injury for the shooting of Curra, in an allegedly Finks-related crime against the rival Mongols bikie.
Curra's vehicle was shot at a dozen times in August 2019, after being lured to a suburban street in Bulleen. He miraculously survived the attack, despite being hit with four bullets in the head, neck and chest.
Three men, including Finks bikies Poiva Sita and Sione Hokafonu, were found not guilty of attempted murder by a Supreme Court jury earlier this month, after a weeks-long trial.
Hokafonu had been accused of being one of two gunmen who fired 11 to 12 shots at Curra, after being allegedly driven to the scene by Sita.
Prosecutors alleged the other gunman was Sua.
Sita's brother, Joseph Opapo, was also found not guilty of intentionally causing serious injury in circumstances of gross violence after jurors rejected that he was a second getaway driver.
All three men walked free on March 14 and Sua had been due to face a separate Supreme Court trial for his alleged role in the attack.
However, prosecutors asked the court to withdraw all serious charges against Sua during a brief hearing in Melbourne on Thursday.
Judicial Registrar Tim Freeman struck out the four charges and ordered Sua to appear at the magistrates court for a less serious charge of failing to provide information or assist under warrant.
Mr Freeman said that charge related to Sua's failure to provide a pass code for an Apple iphone when it was seized by police.
"I'm satisfied that it is appropriate the charge be determined summarily and I order that be transferred to the magistrates court," he said.
Sua will appear at Melbourne Magistrates Court on April 11 to face that charge.
