Vivek Oberoi Moves Delhi High Court Over Misuse of Name and AI-Generated Content

The matter was heard by Justice Tushar Rao Gedela, who stated that the court would pass an order in due course.

In his lawsuit, Oberoi claimed that multiple entities were exploiting his personality rights without authorisation, causing what he described as an “incalculable loss” to his goodwill and reputation. He alleged that fake social media accounts had been created in his name and were being used to share morphed images and AI-generated visuals portraying him in inappropriate and misleading situations.

According to the plea, several videos falsely depict the actor in distasteful scenarios, including inappropriate associations with other celebrities, while also making insinuations about his family life. Oberoi argued that such content is misleading and could make the public believe the visuals to be authentic.

“These videos are vulgar and sexually explicit in nature,” the lawsuit stated, adding that the content creators were exploiting his image to gain traction and monetise views through platforms such as YouTube Shorts.

The actor further alleged that e-commerce websites were selling merchandise such as posters, T-shirts, and postcards bearing his name and likeness without his consent, thereby making unauthorised commercial gains.

Highlighting his entrepreneurial credentials, the lawsuit noted that Oberoi has built significant business interests in India and Dubai and has acquired independent commercial goodwill beyond the film industry. It argued that the circulation of deepfake and morphed content was harming his reputation as a businessman as well.

“He has built independent commercial credibility beyond the film industry and has acquired substantial goodwill as a businessman,” the plea stated, asserting that no individual or entity has the right to misappropriate or imitate any aspect of his personality without his permission.

Oberoi has sought directions from the court to restrain the accused entities from further violating his personality and publicity rights.

His case adds to a growing list of legal actions initiated by public figures against the misuse of their identities. In recent months, actors Aishwarya Rai Bachchan, Abhishek Bachchan, Salman Khan, and podcaster Raj Shamani have also approached the Delhi High Court seeking protection of their personality and publicity rights.
