TS government initiates process for regularisation of contract staff

The State government has started the process of regularising the services of persons appointed on contract basis against sanctioned posts with the Finance Department asking all the department of the Secretariat to forward the proposals for regularisation of eligible persons who fulfil the stipulated conditions.

In an unofficial note Special Chief Secretary (Finance) K. Ramakrishna Rao on Monday is reported to have requested all the departments of Secretariat to communicate it to the Heads of Departments under their control. It is stated that orders were issued on February 26, 2016 to regularise the services of persons appointed on contract basis, subject to the fulfilment of certain condition stipulated in GO 16 issued on that day.

Subsequently, a circular was also issued on the same day with instructions to departments of the Secretariat to forward proposals in the prescribed checklist for regularisation of services of eligible persons, who fulfil the conditions, to the Finance department for scrutiny and concurrence before obtaining orders in circulation as per Business Rules.

However, the High Court issued interim orders on April 26, 2017 interrupting the process of regularisation partially. In its final orders issued on December 7, 2021, the court had dismissed a writ petition paving the way for resuming the process for regularisation of persons appointed on contract basis against sanctioned posts.

Recently, on March 9, Chief Minister K. Chandrasekhar Rao announced in the Assembly that the government would regularise the services of all eligible contract employees — numbering 11,103 — and the note issued by the Finance department on Monday is to take forward the process.

The conditions mentioned in the 2016 GO for regularisation include availability of a post in the relevant category in the respective departments as a pre-requisite condition for considering regularisation — it may be considered only in respect of persons appointed on full-time contract basis on a monthly remuneration and in respect of eligible personnel working as on June 2, 2014, immediately before formation of Telangana State and continuing till the date of proposed regularisation.

Further, other conditions mentioned include — for the purpose of continuity the annual breaks in certain vacation departments like Education and Welfare may be ignored. The condonation shall not, however, apply in respect of breaks on account of unauthorised absence and disciplinary cases, regularisation shall be with prospective effect, i.e., from the date of issue of orders of regularisation and appointment to the category and the backlog in reservations, if any, arising out of regularisation shall be carried forward and treated as backlog vacancies for that particular category.
