Telangana high court sets aside VAT amendment, calls it ‘unconstitutional’

HYDERABAD: In what could come as a huge relief to traders in the state, the high court has struck down the Telangana Value Added Tax (Second Amendment) Act, 2017. The court said the Telangana VAT was contradictory to the intentions of lawmakers who brought in a unified GST regime for the entire country.

A bench of Chief Justice Ujjal Bhuyan and Justice P Madhavi Devi found it unfair and declared the second amendment Act unconstitutional. The judges, who heard several grievances of traders from all over the state, also quashed the notices issued by VAT authorities under the amended Act in the last five years.
