A complex, multistate battle over surrogacy that could set a landmark precedent for parental rights has been unfolding in Texas. On Aug. 12, 2026, a judge reached a critical juncture in the case when the birth of a baby boy brought one part of the dispute to an end. The case pits a surrogate mother against the couple who are the child’s biological parents and who, according to the surrogate’s legal team, had previously wanted the pregnancy terminated.
The dispute began after McKenna West, an Alaskan nurse and single mother of two, entered into a gestational surrogacy agreement with Worldwide Surrogacy Specialists in early 2025. She was paired with California couple Nausheen Gilkar and Omar Ahmed.
