Police will not charge Rudy Farias' mum despite being missing for eight years after claiming there were "no reports of sexual abuse reported".
Houston activist Quanell X spoke to Ruby, along with investigators, on Wednesday when he allegedly claimed the 25-year-old had been hidden and subjected to horrific abuse by his mum, Janie Santana, after she reported him missing in 2015.
He claimed Ruby was forced to sleep in his mum's bed and was made to be her "daddy" as well as being allegedly drugged.
Quanell said: "He said, she would make [him] sleep in the bed with her. [He] didn’t want to sleep in the bed with her. He said she told him he had to be her husband now."
However, at a press conference on Thursday, police revealed the mum will be not charged after claiming there was no evidence Rudy was abused based on the interviews conducted with the 25-year-old.
Sgt Jimenez said: "Based on Rudy’s interview, there were no reports of sexual abuse reported. If there is a disclosure made, we will continue to investigate. The investigation is active, and we will continue to follow those leads."
Police confirmed they are still investigating the mum but the comments from Quanell appear to contradict the alleged abuse claims.
"I interviewed him and no," said HPD Sgt. Jimenez. "I’m trained to listen for probable cause. I’m trained to listen for statements that can help me get charges or move forward with a case and no. There was no statements made during this investigation so far [regarding sexual abuse]."
Quanell appeared to double-down on his comments and said investigators heard exactly the same as he did.
"That detective heard the facts," said Quanell. "Why he’s saying [what he’s saying], I don’t know. But, he heard the exact same thing I heard."
Houston Police Chief Troy Finner says detectives are still investigating the case after he was reported missing for eight years.
"You can’t force a potential victim of a missing person case, to come in and give a statement," said Mr Finner.
On Thursday evening, it was revealed Rudy was staying with his aunt, Pauline Sanchez, after wanting to keep away from his mum despite her trying to contact him.
Pauline told the New York Post: “My son was able to see him. I was able to see him. All that matters is his safety; he’s comfortable.
"He did state, he made the statement that he doesn’t want to see his mom. He doesn’t want to go back to his mom.”
The aunt also revealed Rudy is "traumatized" by the whole ordeal - but the family are glad he's returned after eight years away.
Pauline added: "It was beautiful. He’s okay. [However], my perception has not changed. I still feel that he’s traumatized. He’s gone through a lot. I still feel that further actions need to be taken."
