A Nashville property developer has won a significant legal reprieve after a federal appeals court revived its lawsuit against the city over a building permit that remained on hold for four years. The dispute began in 2022, when SW Nashville EB Owner, LLC, bought a vacant parcel and sought permission to develop it, only for local authorities to suspend the application while considering a possible future road. According to the Pacific Legal Foundation, which represents the developer, the US Court of Appeals for the Sixth Circuit overturned a lower court's dismissal on August 14, 2026, allowing the legal challenge to proceed. The ruling raises broader questions about government planning powers and the constitutional protection of private property.
