In a recent development, a Los Angeles County sheriff’s deputy has agreed to plead guilty to a federal civil rights violation for using excessive force on a transgender man. The incident occurred in 2023 when the deputy, identified as Joseph Benza III, was involved in the arrest of then 23-year-old Emmett Brock.
Benza, 36, was charged with one felony count of deprivation of rights under color of law for his actions during the incident. Following this, Benza and potentially other employees have been relieved of duty by the Los Angeles County Sheriff’s Department. An internal administrative investigation has been initiated based on new information uncovered during the federal investigation.
The incident began when Benza responded to a potential domestic violence disturbance call and encountered Brock, who drove past him and gestured at him. Benza then pursued Brock, leading to a confrontation in a 7-Eleven parking lot where Benza used excessive force on Brock, causing injuries including a concussion, bruising, and cuts.
During the incident, Benza omitted crucial details from the incident report, including the reason for pursuing Brock and the use of excessive force. He falsely claimed that Brock bit him, leading to a series of false statements and a cover-up involving multiple deputies and sergeants.
Los Angeles County Sheriff Robert G. Luna expressed deep concern over the incident, stating that such actions undermine the integrity of the department and erode community trust. Benza is expected to plead guilty to the charges, which carry a maximum penalty of 10 years in federal prison.
The incident also involved a violation of Brock's rights as a transgender individual. Following the arrest, Brock was subjected to a strip search and placed in holding cells inconsistent with his legal gender identity.
