Jurors in the trial of a retired Met Police officer accused of raping a woman have been discharged after they failed to reach a verdict.
Stephen Kyere, 57, was accused of having sex with a woman without her consent after going back to her home in Teddington after a night out on April 12, 2004.
The Old Bailey previously heard that Mr Kyere had flashed his Met Police warrant card at the woman prior to the alleged assault.
Mr Kyere, from Ashford, Surrey, claimed the sex was consensual. He also denies a charge of indecent assault.
The case was reopened after the alleged victim wrote to the Metropolitan Police Commissioner in 2018 about the “injustice” she still felt years after the case was closed.
Jurors at the Old Bailey were unable to reach a verdict on Monday.
The trial had previously heard that Mr Kyere had met the woman at the Oceana nightclub in Kingston-upon-Thames while off duty.
At the end of the evening, the woman took a cab home with a female companion, Mr Kyere and another man, the court was told.
The woman testified that Mr Kyere forced himself upon her while she was drunk and raped her.
Giving evidence, Mr Kyere claimed that the woman fancied him and alleged that she had led him into a bedroom where they had had consensual sex.
The case is being considered for a re-trial.
