MUMBAI: Invoking fundamental right to equality, Bombay high court on Friday held that not only adults, but even a child in conflict with law can approach courts to seek anticipatory bail.
A bench of Justices Sarang Kotwal and Bharat Deshpande, answering a reference to it held, “A ‘child’ and a ‘child in conflict with law’ as defined under the Juvenile Justice (Care and Protection of Children) Act, 2015 can file an application under Section 438 (for pre-arrest bail) of the Code of Criminal Procedure, 1973.”
