KOCHI: The high court has scheduled a detailed hearing on Tuesday on the anticipatory bail filed by actor Dileep in the new case alleging conspiracy to kill the investigating officers in actress assault case after prosecution demanded that phones surrendered by the actor should be handed over to the crime branch and Dileep's counsel hinting that a plea for CBI probe may be filed.
As directed by the court at the earlier hearing, Dileep and other accused had surrendered six phones to the high court on Monday morning, with three of them belonging to the actor.
Though an iPhone was included in the list submitted by prosecution, Dileep has informed the court that the particular phone is not in his possession now as it had got damaged earlier.
During Monday's hearing, both prosecution and defence alleged that unwanted media attention is being given to the case.
Responding to the submissions, Justice Gopinath P said the court will consider the entire facts and take a decision, without being affected by the media reports.
Dileep's counsel argued that the new case was fabricated to get the actor in custody, which they could not do in the other case until now.
In an application submitted by prosecution, it was alleged that Dileep and others are trying to destroy critical evidence.
Even though they had appeared for interrogation, they refused to hand over the mobile phones by claiming that the phones have been sent for forensic examination through their lawyers.
Digital evidence is crucial in this case as the allegation against the accused is criminal conspiracy, prosecution had alleged.
