A partner seeking dissolution of firm cannot continue business in its name during pendency of suit: Karnataka HC

BENGALURU: The plaintiff in a suit for dissolution of a firm, cannot seek for renewal of a licence and continuance of the business while the suit filed by him for dissolution of the partnership is pending, the Karnataka high court has ruled in a recent judgement.

Allowing the petition filed by one Nagalinga, Justice Suraj Govindaraj has said that the licence in issued in the name of Marthanda Enterprises by Excise Commissioner should be kept in abeyance and no person should be permitted to make use of the said licence pending the resolution of the suit by Civil Judge (Jr.Dn.) at Mandya.
