WASHINGTON — The Supreme Court will decide whether federal law can prohibit gun possession for people who are subject to domestic violence orders, the first Second Amendment case at the Supreme Court since a decision last year that expanded the right to carry firearms in public.

At issue is a 1994 amendment to the Federal Firearms Act that prohibits those who are actively subject to domestic violence restraining orders from possessing firearms.

The Supreme Court will decide whether federal law can prohibit gun possession for people who are subject to domestic violence orders.

The 5th Circuit noted that such orders can be issued without any credible evidence of a threat to others.

More than 200 women and men in Texas were killed by their intimate partners in 2021, according to the Texas Council on Family Violence. In an abusive dynamic, leaving an abuser is the most dangerous time for a survivor.
