The residents of Tathony House are "nervously waiting" the decision of the Residential Tenancies Board one month on from hearings.
Those living in the block of 35 apartments in Dublin 8 have had an eviction date of June 2 lingering over their heads since they were given notice back in October due to the landlord deciding to sell the building.
While some tenants have been overholding since attending hearings with the RTB in early June , others have left and had to "move to places like Dundalk, Drogheda, Ashbourne or move out of an apartment into a single room".
The residents argued to the RTB that the eviction is illegal because they believe the landlord doesn't satisfy the get out clauses for the "Tyrellstown clause." The clause says you can only evict more than 10 units if the sale with tenants in situ would deliver a price reduced by more than 20% and the landlord must also prove "hardship".

Tathony House tenant James O'Toole told Dublin Live: "The longer we go without an RTB decision, the more nervous people get and they'll give up and go.
"I heard one of my neighbours leaving the other day. Hearing someone packing up their stuff with boxes and going in and out of the door, for some reason my adrenaline just went through the roof because I was picturing packing up my own stuff and thinking, where would I go?
"And I've talked to the people who did leave since the eviction date. A family has moved to Ashbourne which is 20 kilometres from Dublin. Another guy upstairs with kids had to move to Dundalk and they had to change schools.
"In order to find something in a reasonable budget range, people have to go miles out of Dublin."
He added that the RTB needs more resources so decisions can be made quicker to "save us the sleepless nights".
A spokeswoman for the Residential Tenancies Board told Dublin Live: "Please note that the RTB cannot comment on any individual or ongoing dispute resolution cases. Therefore, the RTB cannot divulge when a decision is expected to be made.
"However, all determination orders arising either from an adjudication or a tenancy tribunal (if the case is appealed) will be published here on the RTB’s website in due course."
