Support worker gets warning for angry confrontation with superior

A support worker tasked with helping people with additional support needs has been warned after becoming aggressive with one of his superiors.

Jaroslaw Musialkowski, from Livingston, was said to have taken hold of a senior colleague’s arm to restrain him and attempted to remove him from a manager’s office while physically restraining him.

The Scottish Senior Services Council (SSSC) heard he also engaged in an argument with the man – known as AA.

Musialkowski worked as a Complex Needs Practitioner at the Richmond Fellowship Scotland at Teviot Court in Penicuik at the time of the incident in October 2020 but was dismissed after.

The SSSC imposed a 12- month warning on his registration, along with conditions he must meet.

The report said: “You had provided a statement to your employer which was largely in line with the evidence of the other witnesses. You accepted you were in the office and AA had repeatedly asked you to leave.

“You accepted you had refused to leave until he said please. You agreed AA had lifted your food and thrown it from the office into the pod. You said you grabbed AA’s arms to prevent any further physical aggression from him and to prevent any damage to your property.

“You did not accept physically lifting him and taking him to the door nor that his feet left the floor.”

The report concluded: “At the hearing, the Panel decided that all of the allegations (as amended) against you were proved, that your fitness to practise is impaired, and made the decision to impose a warning for a period of one year and conditions on your Registration in the part of the Register for Support Workers in Care at Home Service and Support Workers in a Housing Support Service.”

The Richmond Fellowship Scotland was approached for a comment.
