Furthermore, any migrant attempting to cross the border twice during this closure would be banned from entering the United States for a year.

When questioned about the existing authority to close the border, Senator Kramer explains that currently, the DHS has the discretion to do so. However, the leaked document suggests that the DHS secretary would be mandated to close the border once the threshold of 8,500 crossings per day is reached. While Senator Kramer acknowledges that this number is high, he believes that there were several days last month when the border could have been closed instead of allowing an influx of 10,000 to 12,000 individuals. Although the senator views this provision as a step in the right direction, some argue that it merely codifies existing discretionary powers.
