KOZHIKODE: The Kozhikode sessions court has, in its order granting anticipatory bail to writer and activist Civic Chandran, observed that Section 354A of Indian Penal Code pertaining to sexual harassment will not prima facie stand against the accused as the woman complainant was wearing a "sexually provocative" dress.
The remarks made by district sessions judge S Krishna Kumar by relying on photographs of the complainant produced by the accused have kicked up a row, with women activists and legal experts criticising the order. "The photographs produced along with the bail application by the accused would reveal that the defacto complainant herself is exposing to dresses which are having some sexual provocative one. So Section 354A will not prima facie stand against the accused," the order said.
