Rachel Allen's son Joshua withdraws appeal against drugs conviction which could trigger suspended sentence

Celebrity chef Rachel Allen’s son has withdrawn his appeal against a drugs conviction.

Joshua Allen’s move could trigger a 15-month suspended sentence he received for the possession of more than €22,000 worth of cannabis for sale or supply.

Prosecutor John Brosnan told Midleton District Court the 21-year-old had withdrawn his appeal of a two-month term imposed in 2020.

But defence solicitor Don Ryan said his client still contests the severity of the sentence imposed for possessing €280 of cocaine in Midleton, East Cork.

Judge Helen Boyle remanded him on continuing bail until his appearance before Cork Circuit Court on May 20.

This conviction could trigger the revocation of a partly suspended term he received in 2020 for arranging to have €22,000 worth of cannabis posted to himself.

Allen will find out in May if he faces an additional 15-month prison sentence for cannabis sale and supply for an offence dating back to 2018. .

He pleaded guilty to having cocaine at the Pontoon, Midleton, Co Cork, on July 10, 2020.

Last September, Judge Alec Gabbett jailed him for two months having convicted him of the offence. Mr Ryan lodged an immediate appeal and bail was granted in the case.

Allen, of Ballinamona, Shanagarry, Co Cork, had been released from prison just over a month before the offence took place.

He has six previous convictions for drugs related offences all arising from a single incident two years ago.

Allen was handed a 15-month custodial sentence with 15 months suspended in 2020 for possession of cannabis for sale and supply.

He was arrested after customs officers at Portlaoise Mail intercepted a package he mailed from the US.

That sentence was imposed after he had attended residential tratement for drug use.

In relation to the cocaine charge from July 2020, Allen had continued to protest his innocence until the entry of a guilty plea yesterday

At the hearing last September gardai said he had thrown something in to the bushes when he was approached on the Pontoon in Midleton.

In evidence he denied throwing anything in to the bushes when gardai approached youths following a noise complaint.
