Police officer 'grabbed woman and threatened to break her neck'

A Merseyside Police officer could face the sack after allegedly grabbing a woman and threatening to "break her neck".

PC Robert Marshall is accused of "excessive force" by restraining the woman "by the neck" on three occasions. He is also alleged to have told her "don’t f****** grab me or I will break your f****** neck" and called her a "k***head and a rat".

PC Marshall is due to appear at a misconduct hearing before an independent panel at Merseyside Police HQ, on Cazenau Street, in September. If found guilty of gross misconduct as alleged by Merseyside Police's Professional Standards Department (PSD), PC Marshall could face immediate dismissal and be placed on the College of Policing barred list, prohibiting him from working in any policing role in the UK.

According to a public notice of the hearing, PSD detectives allege PC Marshall is guilty of breaching standards around 'Use of Force': "In that the restraint of a female by the neck on three occasions, one of which occurred when she was not under arrest, amounted to excessive force, which was not necessary, proportionate, or reasonable in all the circumstances."

The notice also states: "Saying aggressively to the female, who was the victim of a domestic assault, “don’t f****** grab me or I will break your f****** neck” and calling her a "k***head and a rat". The officer failed to treat her with authority, respect and courtesy." The force says this breached standards around 'Authority, Respect and Courtesy'.

In a further charge, PC Marshall is accused of breaching standards around 'Duties and Responsibilities' by failing to "complete a statement and use of force form" after the incident.

A statement from Chief Superintendent Jennifer Wilson, head of the force’s Professional Standards Department, said: “Merseyside Police expects the highest professional standards from all officers and staff.

“As these misconduct proceedings are yet to be heard and follow an investigation by the Independent Office for Police Conduct (IOPC) it would be inappropriate for us to comment further at this time."
