A one-time prisoner of Perth assaulted a guard during a disturbance in one of the jail’s halls.
Calum Smith struggled with the guard after he was alerted to the disturbance early one morning in November last year.
“The complainer was on duty within a staff office when he was made aware of a disturbance,” depute fiscal Elizabeth Hodgson told Perth Sheriff Court.
Ms Hodgson said the guard made his way to Hart’s cell on A Hall to see what was happening and tried to calm things down.
“However the accused appeared to be under the influence of some substance.”
Ms Hodgson said a “very agitated” Hart then lunged at the guard and struggled with him.
“He suddenly lunged and began to struggle with the complainer,” she said.
Ms Hodgson said she had no note of the guard being injured in the struggle.
Hart (26), who was said on court papers to now reside in Leslie, admitted assaulting a named guard at HMP Perth by seizing him and struggling with him on November 4 last year.
He also admitted a second charge of being caught in possession of a prohibited SIM card at the jail on October 26 the same year.
The court heard Hart had been on remand at HMP Perth when he committed the two offences last year.
Sheriff David Hall sentenced him to complete 90 hours of unpaid work and placed him under the supervision of social workers for one year.
