NJ man orders Jersey Mike’s cheesesteak, allegedly finds delivery driver’s dentures embedded in the sandwich: ‘Shocking and offensive’

Jersey Mike’s subs commonly contain delicious ingredients like ham, turkey, roast beef, salami, provolone, Swiss cheese, and the “Mike’s Way” salad. But one thing it’s safe to say isn’t on a common list of ingredients is a set of someone’s dentures!

The NY Post has reported on a nauseating lawsuit from New Jersey man Fernando Rodriguez, who in April 2025 decided to order a Jersey Mike’s cheesesteak sub from Grubhub. The sub was duly delivered by driver Theresa Gildea, but even before he chomped down on it, Rodriguez says something seemed off.

Rather than the usual restaurant packaging, this sub “appeared packaged and sealed with scotch tape”. He probed further and, as per his lawsuit, made a disgusting discovery: “foreign objects, specifically dentures, embedded within the sandwich.”

He immediately contacted the Jersey Mike’s in Lacey Township, with the manager reporting that Rodriguez arrived with both the cheesesteak and the dentures, and wanted an explanation. The manager is then said to have noted the delivery bag had been tampered with and contacted the police, who contacted Gildea.

She immediately blamed her father, saying he’d been eating at this Jersey Mike’s and that “it was his dentures inside of Fernando’s sandwich.” The cop pressed her to own up. Gildea switched tactics, now claiming she “accidentally placed her dentures in Fernando’s sandwich” as part of a mix-up arising from her eating her own lunch and checking her delivery orders to make sure they were correct.

“Serious concerns about contamination and food safety”

Rodriguez is now suing Gildea, Grubhub, and Jersey Mike’s, saying he “experienced extreme shock, disgust, emotional distress, nausea, loss of appetite, and physical revulsion” from the experience. As his attorney, Ian Goldman, says:

“Finding a foreign object that came from another person’s mouth, in direct contact with a sandwich, is not only shocking and offensive, but raises serious concerns about contamination and food safety.”

The suit places responsibility on Gildea for “tampering” with the sandwich, but also blames Grubhub for negligence, and Jersey Mike’s for failing to “properly package, seal, and secure food.” Grubhub told the Post they were troubled by the story and that “We can confirm the individual in question is no longer contracted to deliver with Grubhub.”

Neither Jersey Mike’s nor Gildea has commented. Gildea was, however, informed by cops that her missing dentures were waiting for her to collect them at Jersey Mike’s.
