
Both leaders formally submitted their resignations through designated representatives. Nitish Kumar’s resignation letter was delivered to the Chairman of the Legislative Council by MLC Sanjay Gandhi, accompanied by Parliamentary Affairs Minister Vijay Kumar Choudhary. Meanwhile, BJP state president Sanjay Saraogi submitted Nitin Nabin’s resignation to the Speaker of the Legislative Assembly.
Legislative Council Chairman Avadhesh Narayan Singh confirmed that Nitish Kumar’s resignation had been accepted, praising his tenure and contribution to the state. He described Kumar as an “invaluable leader” who remained committed to Bihar’s development throughout his service.
Nitish Kumar and Nitin Nabin were elected to the Rajya Sabha on March 16, making it mandatory for them to relinquish their memberships in the state legislature within 14 days. This requirement is in accordance with the Prohibition of Simultaneous Membership Rules, 1950, framed under Articles 101 and 190 of the Constitution, which prohibit holding seats in both Parliament and a state legislature simultaneously.
Explaining the process, Vijay Kumar Choudhary stated that Nitish Kumar had entrusted his resignation letter to Sanjay Gandhi for submission, reaffirming the Chief Minister’s commitment to constitutional norms.
On the BJP side, Sanjay Saraogi noted that Nitin Nabin had pre-scheduled engagements outside Patna and had handed over his resignation before departing. Nabin also addressed the people of his constituency, Bankipore, expressing gratitude and assuring continued connection despite his new responsibilities at the national level. He has represented the constituency for five consecutive terms since 2006.
Speculation now surrounds Nitish Kumar’s next move, as he is expected to resign as Chief Minister before taking oath as a Rajya Sabha member. When questioned, Choudhary stated that any such decision would be taken “at the appropriate time” and strictly in line with constitutional provisions.
With Nitish Kumar stepping away from the state legislature, attention is shifting to his potential successor. His departure could mark a significant turning point in Bihar politics, ending over two decades of leadership that has largely defined the state’s political landscape.
