New Yorkers sue Mamdani over luxury second home tax

  • Three New Yorkers are suing Mayor Zohran Mamdani over his recently implemented tax on luxury second homes , accusing the city of ignoring state notice requirements and causing widespread confusion.
  • The lawsuit challenges the Mamdani administration's process for notifying potential taxpayers, specifically its release of a list of nearly 1 million properties and subsequent mailing of 17,000 notices, rather than the underlying law.
  • Plaintiffs in the suit include individuals connected to Mamdani's political rivals, such as the family of a Republican City Council member and an attorney who served under previous mayoral administrations.
  • The city says it was legally required to release the property list and has extended the deadline for homeowners to apply for exemptions, vowing to vigorously defend against the suit.
  • The pied-à-terre tax, passed in May, applies to non-primary residences worth more than $5 million and certain co-ops and condos worth more than $1 million. It is expected to generate $500 million annually for the city’s budget and social services.
