An elderly man has died in hospital more than a week after allegedly being attacked, and his accused assailant is now charged with murder.
Police were called to Ashfield in Sydney's west just before midday on September 29 to find a 76-year-old man had been allegedly assaulted by another man.
He was taken to hospital in a critical condition.
A 58-year-old man was arrested at a shopping mall and charged on Friday with reckless grievous bodily harm and resisting arrest, and refused bail.
The elderly man died in hospital on Thursday, 12 days after being admitted, NSW Police said.
The 58-year-old's charges have now been upgraded to murder and he is set to face court on October 23.
