Man threatened to smash in neighbour's windows and son's face after being woken up by loud music

A neighbour who was angry after being woken up after midnight by his neighbour's loud music stormed over and threatened to smash in all the windows - as well as their son's face.

Aggressive Chad Scarah ignored efforts by the woman who was making the noise to calm him down and instead he threw a drinking glass at one of the windows, smashing it. He went on to warn that "this is just the start" as he threatened to attack her son and "smash his face in" and that he would break all the windows, Hull Crown Court heard.

Scarah, 21, of Bainton Grove, Hull, admitted causing criminal damage on April 21. Bede Porter, prosecuting, told an earlier hearing that a woman who lived near Scarah, and had known him for many years, returned home at about midnight after a night out with friends.

Two of her friends went back to the house with her and they put loud music on the TV. "Upon playing the music, Scarah could be heard shouting from next door," said Mr Porter.

Scarah went round to complain and the woman turned the music down and invited him to join them to talk about the matter. She said that his children could stay over. "He ignored the offer and threatened to smash all the windows," said Mr Porter. She repeated her offer that he could come in and that his children could go there and sleep over.

Scarah ignored that and threatened to attack her son and to smash his face in. He shouted: "I'll f***ing do them all." He went back to his own home, got a drinking glass and returned. He warned the neighbour: "This is just the start as all the windows are going in."

He threw the glass at a lower window, causing a hole and the rest of the glass in the pane to shatter. The drinking glass also shattered around the garden.

"Scarah's girlfriend dragged him inside," said Mr Porter. "Inside, he could be heard banging on the walls and shouting." The woman alerted the police and officers arrived at 12.52am. He was taken to Clough Road police station.

Scarah’s previous convictions included two offences of assault and another of racially aggravated harassment from January 12 this year. He was in breach of an 18-month suspended custodial sentence imposed on May 7, 2020 for two offences of criminal damage, three of harassment, one of affray and two each of driving while disqualified and having no insurance.

Cathy Kioko-Gilligan, mitigating, told the previous hearing that Scarah behaved appallingly and with immaturity. He and his girlfriend, with two children aged six and three, were asleep in bed when they were suddenly awoken by the music.

"He could have dealt with the situation better," said Miss Kioko-Gilligan. "It reflects his immaturity and his immature years. He can see where he has made mistakes."

Sentencing had been deferred on May 26 so Scarah could prove that he could keep out of trouble, cooperate with the probation service and continue seeking help for his problems. At a resumed hearing, defence barrister Rachel Scott said that there had been no new offences and Scarah had been keeping appointments with the probation service.

He was given 15 days’ rehabilitation and was fined £100 for breaching the suspended sentence. A community order made on January 23 was revoked.
