Man claimed ex-partner had HIV on social media and stalked him for three days

A man who posted claims on social media that an ex-partner had HIV is facing jail.

Robert Fleming, 38, turned up outside his victim's house in Falkirk, Stirlingshire, shouting and swearing, and making threats and derogatory remarks, a court heard.

He then repeatedly posted photographs of his victim on social media and uploaded derogatory posts about him, stated that he had HIV, and offered to provide the man's contact details online.

At Falkirk Sheriff Court today, Fleming, a first offender, of Grahamston, Falkirk, pleaded guilty to stalking the man over a three-day period, between November 17th and 20th last year (2021).

Sheriff Derek Livingston deferred sentence until June 16th for background reports, including an assessment of Fleming's suitability for a restriction of liberty order, under which he would be subject to a curfew and required to wear an electronic ankle tag.

The full facts of the case will be narrated at the adjourned hearing.

Solicitor Murray Aitken, defending, reserved mitigation until then.

He told the court: "There's a lot to it."
