BHOPAL: A division bench of MP high court on Wednesday fixed the case for final hearing on June 27 in which a transgender petitioner had said that not making provision for appointment of transgender persons in the vacancies advertised for appointment of class IV employees in MP high court was a violation of her fundamental rights after the court was informed that the state government has not filed reply in the matter as yet.
The petitioner Noori said that a notification for appointment of class IV employees in MP high court had been issued on October 26, 2021. The application was to be submitted online but when she sought to make an application online, there was no provision of appointment of transgenders in the notification. The petitioner contended that she was as much a citizen of the country as anyone else and denial of a job on the ground of her gender was in violation of her fundamental rights. It was also contrary to rulings of the supreme court on the issue and provisions of Transgender Person Protection & Rights Act-2019.
The court, while ordering that the appointments on the class IV posts in M,P high court will be subject to the court's final order on the petition, had issued notices to respondents to file a reply in the matter.
When the petition came up for hearing on Wednesday before the bench headed by chief justice R V Malimath, it was informed that the state government has not yet filed a reply to the petition. Following this, the court deferred hearing in the case, fixing the case for final hearing on June 27.
