Kilbarchan woman assaulted neighbour and claimed she had made comments about her deceased son

A Kilbarchan woman grabbed her neighbour by the face, claiming she had made remarks about her dead son.

Karen McKinely, of Wheatlands Drive, grabbed Elaine Weir's face and scratched it amid claims she made comments about her son passing away.

McKinely, 56, waited for Ms Weir to return from work before confronting her in the garden on March 16, last year.

The procurator fiscal depute told Paisley Sheriff Court that the incident took place in a shared garden area at Wheatlands Drive.

He explained: “Around 6.35am, Elaine Weir left for work and at this time there was a short argument between Weir and the accused’s son in relation to the accused’s possessions.

“Around 4.30pm, Ms Weir returned home from work and entered the garden through the gate when the accused left her home and walked towards Ms Weir in an angry manner.

“She began shouting and swearing about her possessions and while shouting, she lunged towards Ms Weir and grabbed both sides of her face scratching it before letting go.

“Ms Weir went inside in a state of fear and contacted the police.

“Around 11pm police officers took statements and photographs.

“The accused was later traced in her home address and was cautioned and charged.”

Sheriff Murdo Macleod QC asked the court what phrases were said to Elaine Weir during the incident.

Defence agent, Ruth Wallace told the court that from the summary of evidence, it stated Ms McKinley said: “You leave my f*****g things alone, you fandan.”

Ms Wallace told the court the incident was a result of “ongoing issues that came to a head that day.”

Ms Wallace added: “Ms McKinley lives with her other son and her stance is that her possession were being damaged by the complainer.

“There has been ongoing disputes for quite some time.

“An argument took place and Ms McKinley claims that the complainer said to her, ‘It’s no wonder your son hung himself.’

“These comments provoked the reaction and it’s unfortunate the reaction was what it was.”

Sheriff Murdo MacLeod QC asked if McKinley’s son did take his own life and - from the dock - Ms McKinley sobbed, ‘Yes.’

Sheriff Macleod QC deferred sentencing for McKinley to be of good behaviour for one year.

McKinley was ordained to return to court on June 15, 2023.
