Justin Millington gives evidence in Newcastle court for alleged Tinder sex assault trial

A man who met two Newcastle women on the Tinder dating app has told a District Court trial it was not in his character to sexually abuse them.

Newcastle District Court heard Justin Kane Millington, 49, started chatting with his first alleged victim on Tinder using the profile Bob37.

He has pleaded not guilty to having sexual intercourse with her against her will five times on October 7, 2020.

The woman alleged she was raped in bushland off Newcastle's Fernleigh Track.

On Friday, Mr Millington took the stand in the Newcastle District Court and rejected the allegations.

He said they met, hugged and he may have given her a kiss on the cheek.

The court heard they walked along the track before the alleged assault.

 "We just kept walking," he said.

When asked by his barrister Bill Hussey if he threatened her, he replied "no, I'm not that type of person".

The court had previously heard Mr Millington took his Tinder date into the bush further down the track and raped her five times.

The woman spent hours giving evidence on Tuesday.

"I couldn't even speak, I was scared because I knew I was somewhere where I was not easily seen by the track," she told the court.

"I wasn't able to physically push him off of me."

On Friday, Mr Hussey asked Mr Millington "if you thought [the alleged victim] was not consenting what would you do?"

"I would have stopped straight away," Mr Millington replied.

"I have never ever assaulted my wife and I have never ever assaulted any other woman.

"It is not in my character."

Second woman allegedly said 'stop'

A second woman who had also met Mr Millington on Tinder said while giving evidence on Thursday she was sexually touched in her own home against her will in October 2021.

Mr Millington was again asked by his barrister on Friday what he would do if thought the woman had not consented.

"I would have stopped straight away," Mr Millington replied.

The woman previously told the court Mr Millington asked "how about we go into the bedroom and see if we are compatible in there?"

She said her response had been "no".

She said he then gave her a massage and started touching her.

"I was struggling and saying, 'stop', and managed to get up and say 'time for you to go'," she said.

The woman said Mr Millington returned to her home unannounced two weeks later while she was on the phone to a friend.

"I was petrified, I hid in a bedroom and was whispering to my friend that Justin was back," she said.

On Friday, Mr Millington said he'd had a lot of laughs with the woman and decided to "pop in" to tell her "it wasn't going to work" between them.

Mr Millington fought back tears when describing the state of his marriage at the time of the alleged offences.

He said his wife had gone "off intimacy" and that before turning to Tinder he "faulted" with another woman and after that he felt "so terrible".

He is due to be cross examined by Crown prosecutor Kristy Mulley on Monday.

The trial continues.
