The judge pointed out the disparity in treatment, noting that Navarro had been imprisoned for contempt of Congress after refusing to comply with a congressional subpoena related to the January 6, 2021, Capitol attack.

Reyes criticized the DOJ's stance, emphasizing the potential implications of allowing government employees to disregard subpoenas. She raised concerns about the message this sends to the legal community and questioned the DOJ's justification for not compelling Daly and Morgan to testify.

The House Judiciary Committee's lawsuit revolves around seeking testimony from Daly and Morgan regarding their involvement in the Biden family investigation. The committee alleges that the pair had insights into irregularities in the DOJ's probe that may have favored Hunter Biden, particularly in relation to suspected tax crimes dating back to 2014 and 2015.
