Consumers who buy hemp-derived THC drinks, gummies, and tinctures are facing two different deadlines this fall, and a Senate spending bill released on Aug. 2 would separate them further. The proposal would hold most of the federal hemp restrictions in abeyance until December 11, but it carves out one category that would lose legal hemp status on November 12 regardless.
That carve-out is the detail most likely to surprise shoppers. Under the Senate Appropriations Committee proposal, products containing cannabinoids that cannot be naturally produced by a Cannabis sativa plant would still be recriminalized on the original date. Everything else in the package, including the provision that would eliminate most of the consumable market, would wait until December 11.
