An FBI agent who was previously acquitted of attempted murder charges in connection with a 2020 off-duty shooting on a Metro Red Line train near Bethesda, Maryland, has been arrested in Maryland on charges related to allegations of sexual assault.
Special Agent Eduardo Valdivia, 40, was arrested by the Montgomery County Department of Police following accusations of sexually assaulting two women. The Special Victims Investigations Division is urging any additional victims to come forward, with a news conference scheduled for Tuesday to encourage them to do so.
Valdivia has been suspended by the FBI pending the conclusion of the Montgomery County police investigation. The FBI spokesperson emphasized the seriousness with which the agency takes allegations of criminal violations and misconduct.
In the 2020 incident, Valdivia was charged with attempted second-degree murder and other offenses after shooting a man on a train following a verbal altercation. Despite being indicted in 2021, Valdivia was acquitted of all charges in December 2022.
Now facing new felony and misdemeanor charges, including two counts of second-degree rape, Valdivia was arrested on Monday. His attorney, Robert Bonsib, stated that they are withholding judgment on the allegations until all evidence is presented.
Valdivia, who joined the FBI in 2011 and was promoted to supervisory special agent in 2019, had been working at the FBI since his acquittal in the train shooting case.
Following his initial court appearance, Valdivia was ordered held in custody and is scheduled for a bond hearing on Tuesday. The FBI agent's legal proceedings continue as the investigation unfolds.
