Family of boy who fell to death on holiday say ‘consequences’ will never end

  • Joshua Foster, 37, has been fined 3,000 euros (£2,500) at Paphos District Court in Cyprus after pleading guilty to recklessly causing the death of his two-year-old son.
  • The tragic incident occurred on 12 July, the first day of the family's holiday, when the toddler fell nearly 40ft from a fourth-floor window at the King Evelthon Beach Hotel and Resort in Chlorakas.
  • The court heard that Foster had placed his son on the windowsill to look out at a waterpark, unaware that a section of the window was open, causing the child to fall before he could grab him.
  • Judge Froso Christodoulidou applied the maximum possible mitigation to the sentence after Foster's defence team argued the fatal fall was a momentary lapse of attention rather than negligence.
  • Following the trial, the child's family paid tribute to their deeply loved son, expressing relief that the legal proceedings had concluded while requesting privacy as they navigate the lifelong consequences of the tragedy.
