Elswick dealer caught selling drugs in city centre bar had cocktail of narcotics in underwear

A drug dealer caught selling narcotics in a city centre bar has been spared prison.

Josemar Fernandez was in Perdu, in Newcastle city centre, when he was spotted dealing by the manager. A court heard he was huddled with his brother and another man he was selling to.

When the 34-year-old, formerly of Elswick Court, Elswick, Newcastle, was arrested he was found to have a cocktail of drugs in his underwear. Further evidence of his dealing were discovered at his home and on his phone.

Nicoletta Alistari, prosecuting, said it was in August 2018 that his activities came to light. She told Newcastle Crown Court: "The manager formed the view they were selling drugs and asked security to take them aside.

"The third man was drunk. He confirmed he had bought drugs and had a small deal of cocaine in his jacket."

When Fernandez was arrested he was found to have cocaine, MDMA and cannabis in his underwear. He said he didn't know the drugs were there and claimed he was being framed.

However examination of his phone revealed messages consistent with drug dealing. And at his home, police found self sealing bags and scales.

Fernandez who has eight previous convictions, including possessing a firearm with intent to commit an offence and robbery, pleaded guilty to possessing cocaine, MDMA and cannabis with intent to supply. Recorder Emma Smith sentenced him to 22 months suspended for two years with 300 hours unpaid work and £500 costs.

Nick Lane, defending, said: "It's not a way of life he wishes to return to. He has met a new partner since this offence and has moved away from Newcastle city centre, away from the negative influences. They are living in Wallsend."

Mr Lane said Fernandez, who has a son, has "returned to his love of music" and begun to write poetry as well as music and "has had some success". He has been signed to a management company and hopes to start performing locally.
