In a judgment delivered on September 30, 2026, the Delhi High Court upheld an eviction order against a daughter-in-law and also upheld the validity of the Delhi rules that allow authorities to order eviction of children or legal heirs in cases involving non-maintenance or ill-treatment.
The case is significant because the court had to balance two competing protections: the senior citizen’s right to protection of life and property under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, and the daughter-in-law’s right to reside in a shared household under the Protection of Women from Domestic Violence Act, 2005.
