Canberra woman accused of involvement in Glenn Walewicz murder denied bail

The woman accused of orchestrating the home invasion that led to the death of Canberra man Glenn Walewicz will remain behind bars until the start of her trial after she was refused bail in the ACT Supreme Court.

Mr Walewicz died when he was shot in the neck and chest as he answered the door to three people wearing masks, in June 2021.

Police allege the aim was to steal drugs and money from a particular house, but the group went to the wrong address and Mr Walewicz died as a result of mistaken identity.

It took the police a year to work out who was responsible for the crime but an 18-year-old man has now pleaded guilty to murder, admitting he pulled the trigger.

A second man, Gary Taylor, has also pleaded guilty to murder for his role, but charges against a 12-year-old were abandoned by the Director of Public Prosecutions.

Nicole Williams, 38, is facing seven charges from attempted aggravated burglary, to recruiting a child to commit a crime and accessory after the fact of murder.

Court documents reveal the police case is that Ms Williams gave the gun to the boy who fired the shot, later arranging to dispose of the weapon and to silence anyone who might reveal who was involved.

On Monday in the ACT Supreme Court, Ms Williams's lawyer asked for bail, saying the prosecution case was weak, that she was not even there and she faced an unreasonably long wait in jail until she would face trial.

But prosecutor Anthony Williamson pointed to a series of text messages prosecutors believed showed a strong case against Ms Williams.

One from Ms Williams to another person about recruiting the 18-year-old who shot Mr Walewicz read:

"'Gaz's number' Message him when [redacted shooter's name] is ready do them fullas [two intended victims] over tell [redacted shooter's name] over Woden ways… they live."

That was followed by a text confirming the 18-year-old was prepared to go ahead with the crime.

Immediately after the events Ms Williams sent text messages which said: "he shot him in the face... scary" and "The lad died AFP page".

In documents tendered in court, prosecutors said the messages revealed Ms Williams's involvement in the crime.

"These messages are significant because police did not publicly announce the death of the deceased until 11:30," the submission reads.

Police said they also did not reveal Mr Walewicz had been shot in the face.

Prosecutors told the court they would allege Ms Williams identified the targets, recruited those to take part and provided the gun.

Police said they believed the burglary would have been for her benefit, netting drugs and money.

Associate Justice Verity McWilliam said there was relevant evidence against Ms Williams.

She also said it was likely Ms Williams would go to trial later this year, which was not an inordinate time to wait.

Bail for Ms Williams was refused.

No date has been announced to sentence the 18-year-old who admitted pulling the trigger however Mr Taylor will be sentenced for his role in the crime next month.
