Body of Nottingham man who died after altercation in Spain to be returned to UK

The brother of a man who died while on holiday in Spain announced a "huge step forward" in helping him "lie down in peace". Nottinghamshire entrepreneur Maximillian White, who has made his wealth from medicinal cannabis and owns a property on the holiday island of Mallorca, has announced his brother's body will return to the UK after months of fighting.

Dad-of-two Tobias White-Sansom, 35, was taken to hospital on July 26 and placed in an induced coma after an alleged incident at the Boomerang nightclub in Magaluf on the Spanish island. The death of Mr White-Sansom, who grew up in Radford, prompted calls for an independent inquiry and his body to be returned to the UK.

The Nottinghamshire multimillionaire said the family is "relentless" in finding what happened to his late brother. Mr White, speaking to Nottinghamshire Live from Madrid, said the coroner in Spain has signed off the documents for Tobias' body release on Friday, October 7.

It comes as coroners have conducted a second autopsy September 20 - and the case is now in the hands of the judicial authority in Spain. It will now take around four weeks for Tobias' body to be repatriated to the UK, the family said.

Once arrived in the UK, Mr White said they will have an inquest opened into the circumstances of his brother's death. He vowed that he will "bring justice to my brother" - and push for his case to be heard in the European Court.

He added: "It is getting more and more difficult to make sure we have a thorough autopsy in the UK, which is what we wanted from the beginning. The worst thing that they could have done is saying that they will not release the body.

"The second worst thing that they could have done is leaving it until now. We are Roman Catholic, we were meant to bury him within a month - and that has not been possible.

"Now we are just receiving the body that has had two autopsies, being kept in the freezer to be ready for transport. We really do not know what we are going to receive on the other end."

He revealed the steps that he is looking to take once his brother's body arrives in the UK. Mr White added: "Once the body is here, we are putting the dossier for the Parliament and Foreign Office.

"The next step is that we will launch an independent inquiry from the UK, making it a public court case in England. We will move it to the UK or the European Court - most likely the European Court."

In a statement to Nottinghamshire Live, a spokesperson for Guardia Civil stated that the "man was expelled from the nightclub for his aggressive behavior and refusal to wear a T-shirt". The family, however, claimed Tobias was the one approached by bouncers and an altercation broke out.

Mr White added: "It is not easy losing a loved one. But losing a loved one in these circumstances is even more difficult. The only thing that brings comfort is that we now have the government and our people fighting for us.

"And eventually someone is going to have to answer the question. It is just a very difficult time for everyone in the family.

"My mum just wants to bury him and mourn in peace. My dad has dementia, so I made the decision not to tell him because I would have to tell him every day the same story and it might just turn into a recurring nightmare.

"We are not going to stop, no matter how long it takes - we are relentless. If I am in a wheelchair and I am still doing it then so be it."

He took a moment to thank "everyone who fought for us and Toby". The heartbroken brother added: "If I was working in a supermarket, I would not have been able to do all this. This is the sad thing and that is why it feels like we have to fight because we have the resources to do it.

"We have to do it for the people who do not have the money to push these things through. This was a massive step forward and I just want to thank everyone on social media, the people who turned up for Toby's vigil, our MPs, family and friends who really showed their support.

"We won a battle and we will see if we can win the war. So many people have come together to show their support and this is the result."

A spokesperson for the Guardia Civil added: "Guardia Civil responded to a notice from the establishment’s private security. This man assaulted the doorman of the nightclub for which Guardia Civil arrested him for a crime of injury.

"The agents had to reduce him due to his resistance and aggressiveness. He was taken to the hospital as an arrested person and the health services administered a painkiller."

In a statement, a Foreign, Commonwealth & Development Office spokesperson said: “We are supporting the family of a British man who has died in Mallorca and are in contact with the local authorities.”
