BENGALURU: The high court has denied bail to Irfan Nasir alias Irfi, arraigned as accused no. 3 in the case registered by NIA in relation to links with the banned terrorist organisation Islamic State Khorasan Province/ISKP, which is a part of banned group ISIS/Daesh.
He had appealed against the July 28, 2021 order of the special court for NIA cases, Bengaluru, wherein his bail application was rejected.
"Perusal of the material on record discloses that there is sufficient material against the appellant-accused no. 3. Prima facie case exists against accused no. 3. Hence, there is no merit in this appeal," a division bench headed by justice K Somashekar said.
The court also held that "it is not necessary that to prosecute any person under the Unlawful Activities (Prevention) Act (UAPA), he should be a member of a terrorist organisation". "What is a 'terrorist act' has been enumerated in section 15 of the Act and the punishment for the same is provided under section 16. The definition of 'terrorist act' in section 15 or 18 that pertains to offence of conspiracy does not refer to 'any person who is a member of terrorist outfit as contained in section 20'," it said.
