- USCIS has retired the narrow label "foreign diplomatic officer" in favor of a much broader one, "foreign government employee" — widening whose U.S.-born children fall outside automatic citizenship.
- The change only reaches kids born from September 4, 2026 onward. A child whose foreign-government-employed parent gave birth even a day earlier keeps whatever citizenship status they already hold.
- A Maryland federal judge blocked enforcement of the underlying executive order against a nationwide class of affected families on September 2 — two days before the rule even took effect — so DHS says it will not apply the new rule to anyone in that class for now.
- DHS admits it has no way to count how many children could be affected. The State Department has put the number of foreign mission staff and their dependents in the U.S. above 124,000, but DHS says that figure doesn't tell you how many of those families actually meet the rule's narrow conditions.
