BENGALURU: Only a court on its own at the behest of the Deputy Commissioner can invoke the revision power under section 58 of the Karnataka Stamps Act and no other person, such as a defendant to a suit, can be permitted to invoke the same, the Karnataka high court has ruled in a recent judgement.
"The entire exercise undertaken under Section 58 would only enable the wrong doer to be prosecuted for an offence under the stamp law by the Deputy Commissioner and would not render the instrument invalid on the ground of insufficiency of duty," Justice NS Sanjay Gowda has added in his order while allowing the petition filed by one Anil, a resident of Bagalakote.
