The Food and Drug Administration said Sept. 28 that it intends to evaluate changes to the framework it uses to review vapes and other new tobacco products, "including through initiation of new rulemaking to replace the current framework," according to an FDA announcement. The agency cited its experience with a 2021 rule, "the widespread development of an illicit and unregulated market," and the pace of new product introductions.
The change could eventually affect which vapes reach store shelves legally. For parents, that matters because most e-cigarettes sold in recent tracking data were products the FDA never authorized, and those products have not gone through FDA review.
