A US federal appeals court has ruled that certain immigrants who entered the country without lawful admission are not constitutionally entitled to individual bond hearings while their removal proceedings are pending. On October 23, 2026, the US Court of Appeals for the Fifth Circuit, sitting en banc, issued a 10-7 decision reversing an earlier ruling that had granted relief to three detained immigrants. According to the court’s opinion in Alvarado v. Vergara, available on Justia , the majority concluded that the Fifth Amendment does not require individual hearings to assess whether the men pose a danger to the community or a flight risk under the immigration detention provision at issue. The ruling reverses orders requiring authorities to provide the men with hearings within 90 days.
