Trump's Attorney To Argue First Amendment Protection In Election Case

Donald Trump to testify in New York civil fraud trial

Following a judge's ruling allowing Fulton County District Attorney Fani Willis to continue overseeing the Georgia 2020 election interference case against former President Donald Trump, the case is set to refocus on its intricate details.

During a recent hearing, Trump's lead attorney in Georgia is expected to argue for the dismissal of the indictment, citing that the former president's political speech is safeguarded by the First Amendment. Notably, Trump himself is not anticipated to be present at the hearing.

In a motion filed in late 2023, Trump's attorney Steve Sadow contended that the dissemination of conspiracy theories and allegations of widespread voter fraud in the 2020 presidential election constituted political speech, asserting that Trump should never have been indicted.

Sadow emphasized, 'The core political speech and expressive conduct alleged in this indictment against President Trump are protected from government regulation and thus criminal prosecution by the State.' He further argued that criminalizing Trump's speech disputing the election's outcome while endorsing the election's result is considered viewpoint discrimination.

After a series of disqualification hearings lasting over two months due to a romantic relationship between Willis and her lead prosecutor Nathan Wade, Willis expressed readiness to steer the case back on course. Judge Scott McAfee ruled that Willis could continue leading the case provided Wade recused himself, which he has done.
