NEW DELHI: A week after barring the Madhya Pradesh government from implementing reservation for OBCs in local body polls,the Supreme Court on Wednesday modified its order and allowed it to allocate quota for the community after being prima facie satisfied that the ‘triple test’ criteria has been complied with.
On May 10, the court had directed that the poll process for 23,263 local bodies in Madhya Pradesh be conducted forthwith and rejected the state government’s plea for more time to fulfill the ‘triple test’ criteria to introduce OBC reservation in local self-governed bodies and complete the delimitation process. The OBC commission set up by the state to collect empirical data for reservation then moved the court through advocate Nikhil Jain and brought to its notice that it had already completed the task.
