Texas Judge Dismisses Alaska Surrogate from Custody Case Over Newborn with Heart Defect as Supreme Court Weighs Stay

A Dallas judge has ruled that an Alaska surrogate is not a parent of the medically fragile infant she delivered in Texas, and dismissed her from the case. State District Judge Ashley Wysocki upheld a California judgment recognizing the child's genetic parents, Omar Ahmed and Nausheen Gilkar of Los Angeles, as his legal parents. According to McKenna West's own court filing, she was dismissed from the case with prejudice in early September.

West, an Anchorage nurse, then asked the Supreme Court to intervene. Her attorneys, from Alliance Defending Freedom, filed an emergency application on September 9 seeking to put the California order on hold while they pursue further review, arguing the California court lacked jurisdiction. Her filing says a stay is needed "to preserve the status quo" so she can stay informed about the child. The court has not acted.
