Following the state's assumption of control over a park in Eagle Pass, authorities have implemented multiple layers of razor wire around the perimeter, effectively limiting access to the Rio Grande. Under normal circumstances, migrants who cross the middle of the Rio Grande are considered to be on U.S. territory and are able to turn themselves in to immigration authorities. However, the fortified fencing, including the layers of razor wire, now obstructs their path. Consequently, Texas authorities instructed migrants to continue walking until they reach Shelby Park, where they will be apprehended if they are unaccompanied single men or single women and charged with criminal trespassing.

In contrast, migrant families and unaccompanied children who present themselves to authorities at the fortified area are handed over to Border Patrol, according to Texas officials. This unique situation highlights the evolving dynamics between the Biden administration and the state of Texas, as the enforcement of state law, rather than federal law, is currently in effect in the area.

Texas Attorney General Ken Paxton has made it clear that he does not intend to yield to the Biden administration's immigration policies.
