Texas has sued Gerber and its parent company, Nestlé USA, alleging that the baby food maker told parents its products were safe, pure, and rigorously tested while its own test results showed high levels of arsenic, lead, and cadmium. Texas Attorney General Ken Paxton announced the lawsuit on Oct. 14, bringing claims under the state's Deceptive Trade Practices Act (DTPA).
The case concerns marketing claims, not a recall. No court has found that Gerber broke the law, and Gerber says its products meet federal limits for heavy metals. The lawsuit still raises a practical question for parents who rely on the brand: what does "rigorously tested" actually mean?
