These terms and conditions (Terms) govern your attendance at, and participation in, the Brooklyn Brewery ‘This is Brooklyn’ Blank Canvas Event (the Event) organized by Carlsberg Marston’s Brewing Company Limited with registered office at Marston’s House, Brewery Road, Wolverhampton, WV1 4JT and company number 00078439 (we, us or our) and managed on the day of the Event by Richmond Towers Communications Limited with registered office address at Lector Court, 151-153 Farringdon Road, London, England, EC1R 3AF and company number 05452146 (Richmond Towers). These Terms are an agreement between us and you. By attending, and/or participating in, the Event, you agree to be bound by these Terms to the exclusion of all other terms. If you do not agree to be bound by these Terms, you will be unable to attend, or participate in, the Event.
Event
1. The Event is expected to take place on Saturday 27th August 2022, from 12pm until 3pm at 500 Brixton Road, Brixton, London SW9 8EQ.
2. Attendance at, and participation in, the Event is free and subject to availability.
3. You do not need a ticket to attend, or participate in, the Event. Eventbrite Inc. (company number, 4742147) (Eventbrite) offers a registration platform via its online services where there is an option for you to register your interest in attending the Event should you wish to do so. Please note that registration is not mandatory and will not guarantee your entry to or ability to participate in the Event. If you chose to register to attend the Event you will receive an email confirmation from Eventbrite. Eventbrite’s Terms of Service, Community Guidelines and Privacy Policy are applicable to your use of Eventbrite’s services.
4. You must be at least at least 25 years of age on the day of the Event in order to attend, and participate in, the Event. We reserve the right to refuse your entry and prohibit your participation in the Event if you are unable to provide photographic identification to prove that you are 25 years old or older.
5. You understand that you and your property may be subject to a reasonable search upon entry to the Event for security reasons. If you refuse to comply with any reasonable request to conduct a search, we may deny you entry. It is forbidden to take into the Event bottles, glass, cans, sticks, weapons, drugs, alcohol or any other objects deemed to be a danger to the safety of others. We reserve the right to deny you entry to the Event or ask that you leave the Event if you violate this term.
6. You understand that a film and photograph crew will be present at the Event. You grant us, our affiliates, employees and agents the right to record, film, photograph and capture your image, voice and likeness, together with the Contribution (as defined in paragraph 11 below) (if any) in any media at the Event (Recordings). You grant us, our affiliates and agents an irrevocable, non-exclusive, perpetual, worldwide and royalty free right to use, reproduce, modify, distribute and translate, in connection with the promotion and marketing of the Brooklyn Brewery brand and the Event, all or any of the Recordings.
7. At the Event, we will ask you to sign an image release and (where you have made a Contribution) an intellectual property release form which will ask you to confirm your name, age and that you accept granting us the rights set out in paragraph 6. If you do not sign this form(s), or you otherwise do not wish for you or your Contribution to feature in the Recordings, you must immediately inform us at the Event.
8. You are permitted to capture audio, photos or videos of the Event and share the same on your social media accounts exclusively for private, non-commercial use.
9. Media presence/queries at the Event will be managed by Richmond Towers.
10. 400 x free Brooklyn Brewery branded caps (Merchandise) will be handed out to attendees at the Event. Limited to 1 item of Merchandise per Event attendee. The Merchandise is subject to availability and is therefore being given away on a first come, first serve basis. No cash alternative is available.
Participation
11. Event capacity is limited and there may be a queue to enter the Event. Depending on your time of arrival and length of queue, you may have the opportunity to participate in the Event by painting on the Brooklyn Brewery mural (Mural) using the stencils provided by us. Requests to paint something on the Mural based on your own creative ideas and work (Contribution) is subject to our express consent which will only be given if we are satisfied that the Contribution is original and will not infringe any third party intellectual property rights.
12. You will be asked to leave the Event if you paint, draw, write (or similar) on the Mural: (a) any rude or offensive words, connotations or abusive, defamatory or profane or otherwise offensive or inappropriate language; (b) third party brands or trade marks; (c) anything which may breach any legal code or requirement which we are required to comply with; or (d) anything which may damage our reputation.
Personal Data
13. Any personal data that you provide in connection with registering for the Event via Eventbrite’s online services will be collected by Eventbrite in accordance with its Privacy Policy. Such personal data will only be shared with Richmond Towers and processed on the basis that is in their legitimate interest to determine the potential number of attendees at the Event and Richmond Towers will only use your personal data for this purpose. 14. The personal data that you provide in connection with your attendance to, and participation in the Event, will be processed by us on the basis that it is in our legitimate interests to promote our brands and we will only use your personal data for this purpose. Liability
15. We may change the date of or cancel the Event at any time for any reason. In such case, you will not be entitled to any refund or any other compensation.
16. You acknowledge and agree that your attendance at, and participation in, the Event is voluntary, and you understand the nature of the Event. To the fullest extent permitted by applicable law, you acknowledge and agree that: (a) you solely assume the risks associated wih attending, and participatiing in, the Event; and (b) we will not be responsible for any loss, injury or damage resulting from your attendance at, or participation in, the Event or from any circumstances beyond our reasonable control incuding (without limitation) strikes, pandemic, lock outs, trade disputes or adverse weather conditions.
17. Nothing in these Terms will limit or exclude our liaibility for death or personal injury resulting from our negligence or that of our employees or to the extent that such exclusion or limitation is not permitted by applicable law.
18. Without prejudice to paragraph 17, we will not be liable to you for any loss of profit, loss of goodwill, loss of business, loss of business opportunity, loss of anticipated saving, loss or corruption of data or information, or for any special, indirect or consequential damage or loss suffered by you that arises under or in connection with the Event. In any case, our, and our affiliates’, aggregate liability under these Terms will not exceed £100.
General
19. We reserve the right to vary these terms and to implement such other restrictions/conditions before and during the Event to ensure it is safe. You must comply at all times with any and all instructions given to you by Event staff and/or the guest artist at the Event.
20. You must not enter or participate in the Event if you believe that you may have been infected with and/or you are displaying symptoms of Covid-19.
21. If any provision of these Terms is held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions of these Terms will not in any way be affected or impaired thereby.
22. These Terms will not create any rights or benefits enforceable by any third party by virtue of the Contracts (Rights of Third Parties) Act 1999.
23. These Terms are the entire agreement between you and us regarding its subject matter. These Terms and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) will be governed by and construed in accordance with English Law, and the parties submit to the exclusive jurisdiction of the English Courts with regard to any such dispute or claim
24. It is not the intention of this Event in any way to encourage people to consume excessive amounts of alcohol. The Promoter encourages responsible drinking and directs all entrants to read www.drinkaware.co.uk for more information.
