CHENNAI: An inquiry into an errant government servant accused of being involved in a criminal case and the departmental action can be initiated simultaneously, says the latest Tamil Nadu government order. There is no legal bar on both proceedings being carried out together.
The government has issued guidelines for simultaneous departmental action against government servants for the same charges as in criminal cases on discharge of their official duty including the trap and arrest case.
As per the GO, the criminal case and the departmental disciplinary proceedings can be initiated simultaneously over criminal misconduct of a government servant. The order states that the two investigation procedures to arrive at the conclusion are different.
The 22 guidelines have been listed out in the order issued by the chief secretary to government, V Irai Anbu, as per a directive of the state governor.
