Supreme Court To Announce Decision On Trump's Immunity Claim

Donald Trump Organization trial in New York State Supreme Court in New York

The Supreme Court is yet to announce a decision on former President Donald Trump’s claims of absolute immunity. The court has scheduled to issue opinions on Wednesday, Thursday, and Friday this week at 10 a.m. ET, with as many as 14 cases still pending. Among the significant cases awaiting decisions are whether Trump can claim immunity from criminal prosecution and whether Idaho can enforce its strict ban on abortions in cases where the health of the pregnant woman is at stake.

Trump's appeal for immunity from special counsel Jack Smith’s election subversion charges reached the Supreme Court late in the term, drawing significant attention. Trump argued that without immunity, presidents would be constrained in office, always concerned about potential prosecution after leaving the White House. During oral arguments in April, this argument seemed to resonate with the conservative-leaning Supreme Court, although it was unlikely that Smith's case would be entirely dismissed.

The crux of the immunity case is expected to revolve around whether Trump's post-election actions were considered 'official' – actions taken as president – or 'private,' which would likely not be eligible for immunity.
